Refund & Cancellation Policy

Overview

This Refund & Cancellation Policy applies to booking amounts and payments made to BMK Future Buildtech Private Limited ("BMK") for units in its projects, including Narayan Villas, Sector 10, Greater Noida West. It should be read together with the signed booking form, allotment letter and agreement for sale.

1. Governing Documents

The refund and cancellation terms in your signed booking form, allotment letter and agreement for sale, and the provisions of applicable law (including the Real Estate (Regulation and Development) Act, 2016 and rules made under it), prevail over this general policy in case of any difference.

2. Cancellation by the Buyer

• A buyer who wishes to cancel a booking must send a written request to BMK at the email or address given below, mentioning the unit details, booking reference and reason.
• Cancellation takes effect only when BMK acknowledges the request in writing.
• On cancellation, BMK may retain the booking or earnest amount and any other amounts as permitted by the signed agreement and applicable law, and will refund the balance, if any, after such deductions.
• Taxes already paid to the government, brokerage or channel-partner fees, and bank or payment-gateway charges may not be refundable, as applicable.

3. Cancellation by BMK

If BMK is unable to allot or deliver the booked unit for reasons within its control, or cancels the booking for any reason other than the buyer's default, the amounts paid by the buyer will be refunded as provided in the agreement and applicable law.

4. Default by the Buyer

If the buyer fails to make payments on time or breaches the terms of the agreement, BMK may, after written notice and as permitted by the agreement and law, cancel the allotment and refund the amounts paid after deducting the applicable charges.

5. Refund Process and Timeline

• Approved refunds are made to the original mode and account of payment, or to the account of the buyer named in the booking, by bank transfer or cheque.
• Refunds are processed after the cancellation is acknowledged in writing, the buyer returns the original receipts and allotment documents, and all formalities are completed.
• The timeline for the refund will be as stated in the signed agreement or, if none is stated, as required by applicable law. Bank processing time may add to the time taken to receive the amount.

6. Non-Refundable Items

Unless the agreement provides otherwise, amounts paid towards stamp duty, registration, GST and other statutory charges already deposited with the authorities, and third-party costs incurred for the buyer's request, are not refundable by BMK; the buyer may claim these directly from the concerned authority where the law allows.

7. Site Visits and Enquiries

No charge is made for enquiries or site visits, and no refund is applicable for them.

8. Disputes

Any dispute about a refund or cancellation should first be raised in writing with BMK using the details below. We will try to resolve it amicably. Otherwise the dispute is subject to the governing law and jurisdiction set out in the signed agreement or, if none, the courts at Gautam Buddh Nagar, Uttar Pradesh.
